Consumer rights for purchases from your studio
Which statements the client makes for a booking, voucher, photos and products, what they receive by email and where you can see the accepted version of your terms.
On your studio pages, you are the seller and Flyp provides the tool. The purchase forms collect the statements required by the Polish Consumer Rights Act from the client, and Flyp saves them with their content, date, IP address and browser. This is your evidence if a client wants to withdraw from the contract.
What the client ticks
- Your studio terms with every booking, voucher, photo purchase and product order, including when you arrange payment outside Flyp.
- A request to start the service before the 14 days are up (art. 21(2)) when booking, if the session date falls within 14 days or the first payment is a deposit. Without this statement, the client could withdraw from the contract and get the whole payment back, deposit included.
- Consent to receive the files immediately (art. 38(1)(13)) when buying extra photos, paying a selection surcharge and buying a digital product in the shop. Files are released only after the consent is saved.
- Information about made-to-order products (art. 38(1)(3)) when the cart contains a product made to the client’s specification, such as an album of their photos. You set this in Settings → Add-on products with the “Made to the client’s specification” field, together with the fulfilment time.
The purchase buttons say plainly that the order involves payment: “Book with obligation to pay”, “Propose the date with obligation to pay”, “Order with obligation to pay” and “Confirm with obligation to pay” (for a photo selection and for an instalment). Without such wording, the contract isn’t concluded (art. 17).
What the client receives by email
The email after a booking or a voucher, photo or product purchase contains confirmation of the contract: the seller’s details (from your Studio profile), the total price, the voucher expiry date, the fulfilment time, information about the right of withdrawal or its absence with the legal basis, a link to the accepted version of your terms and the content of the statements made, with the date.
Versions of your terms
Every saved or accepted text of your terms is kept as an unchangeable version with a SHA-256 hash. You can see the versions and the number of acceptances in “Version history” in Settings → Terms and privacy. The client sees the accepted version in the email and in the client portal, on the session’s “Documents” tab.
A studio without a registered business
If “Private individual (no business)” is selected in the Studio profile, your studio pages tell clients that the seller isn’t a business, so consumer protection rules don’t apply.
Flyp’s terms template isn’t legal advice. It’s worth checking the rules for deposits and withdrawal for sessions on a fixed date with a lawyer.
